These Terms of Use (“Terms”) govern your access to and use of CoveredNightSide (the “Site”), including any blog posts, pages, images, audio, embedded players, newsletter sign-ups and emails, and comment features (together, the “Content” and “Services”).

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1) What this site is

CoveredNightSide is a story-led blog and related content site. We do not sell products or services through the Site. Some parts of the Site may include audio streams and embedded media.

2) Age restriction

The Site contains mature themes and is intended for an 18+ audience.

By using the Site, you confirm you are at least 18 years old (or the age of majority where you live, if higher). If you are under 18, you must not use the Site.

3) Content notice and fiction disclaimer

Content may include strong language, violence, horror themes, and mild sexual references.

Unless clearly stated otherwise, story elements are fictional. Any resemblance to real people or events is coincidental. Real-world places or concepts may be altered for storytelling.

• Remove watermarks, credits, or copyright notices.

• Scrape the Site, use automated tools to copy Content, or use Content to train AI models.

• Use the Content or Site for commercial purposes.

6) Acceptable use

You agree not to:

• Break any applicable law while using the Site.

• Attempt unauthorised access to the Site, hosting, or related systems.

• Disrupt the Site (viruses, scraping, attacks, excessive automated requests).

• Impersonate others or misrepresent your affiliation.

We may restrict or block access if we believe these Terms are being breached.

7) Newsletter (Hostinger Reach)

If you subscribe to our newsletter, we use Hostinger Reach to manage subscribers and send email updates.

By subscribing, you agree that:

• We may email you updates about new posts, episodes, IRL updates, and site announcements.

• Your email address (and any information you submit in the form) will be processed and stored within Hostinger Reach for the purpose of sending these emails and managing your subscription.

• You can unsubscribe at any time using the unsubscribe link in any newsletter email (or by contacting us via the Contact page).

• Email delivery is not guaranteed (messages may be filtered, delayed, or blocked by providers).

• We may change email frequency or content over time.

We do not sell anything through the Site; the newsletter is for content updates and site news.

8) Comments and community features

If comments are enabled, you agree to follow these rules:

8.1 What you must not post

Do not post anything that is:

• Illegal, hateful, abusive, harassing, threatening, or obscene

• Defamatory or knowingly false

• Pornographic, exploitative, or involving minors

• Infringing someone else’s copyright, trademark, privacy, or other rights

• Spam, advertising, or repetitive/promotional content

• Personal information about someone else (addresses, phone numbers, private details)

8.2 Moderation

We may (but are not required to) moderate comments. We can remove, hide, edit, or restrict comments/users at our discretion—especially for rule breaches or to protect the community.

8.3 Licence to display your comment

By posting a comment, you grant CoveredNightSide a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display your comment on the Site (and in backups/archives) as needed to operate the Services.

8.4 No confidentiality

Do not post anything you consider confidential.

9) Audio streams and embedded media

The Site may include audio streaming, embedded players, or links to third-party platforms.

• Audio may be changed, removed, or temporarily unavailable.

• Streaming quality depends on your device and connection.

• Third-party embeds may be governed by the third party’s own terms and policies.

You must not record, rip, redistribute, or publicly perform streamed audio unless you have explicit permission.

10) Third-party links

The Site may link to third-party websites or services. We do not control them and are not responsible for their content, policies, or availability.

11) Disclaimers

The Site and Content are provided “as is” and “as available.” To the fullest extent permitted by law, we do not guarantee the Site will be uninterrupted, secure, or error-free, or that Content will always be accurate or up to date.

The Content is for entertainment and general information only and is not professional advice.

12) Limitation of liability

To the fullest extent permitted by law, CoveredNightSide is not liable for indirect, incidental, consequential, or special damages arising from your use of (or inability to use) the Site or Content.

Nothing in these Terms limits liability where it cannot be excluded by law (e.g., death/personal injury caused by negligence, fraud).

13) Privacy and cookies

Personal data relating to newsletter subscriptions (via Hostinger Reach), contact messages, comment data, and basic technical logs is handled according to our Privacy Policy and (if used) Cookie Policy available on the Site.

14) Changes to these Terms

We may update these Terms from time to time. The “Last updated” date will change. Continued use of the Site means you accept the updated Terms.

15) Governing law

These Terms are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction, unless your local consumer laws require otherwise.
